The rules the calendar follows
Under Texas Property Code section 51.002, a non-judicial foreclosure sale is a public auction held between 10 a.m. and 4 p.m. on the first Tuesday of the month, or the first Wednesday if that Tuesday is January 1 or July 4. The lender must give you notice of default and at least 20 days to cure before it gives notice of sale, and the notice of sale must be given at least 21 days before the sale.
The calculator adds those periods to the dates you enter and finds the next permitted sale day. Those are the earliest dates. A notice can name a later one.
What to do with the answer
- Write the sale date on a calendar and work backward from it.
- Call your servicer and ask what it would take to catch up, or whether a workout is possible.
- Talk to a Texas attorney or a HUD-approved housing counselor about your rights.
- If selling is on the table, a sale has to close before the auction to help. Tell any buyer your sale date the first time you talk.
When this calendar does not apply
Home-equity loans and reverse mortgages generally need a court order before the lender can foreclose, bankruptcy and active-duty military status can change what a lender may do, and your loan documents may give you more time than the statute does.
